Salesman Claims Employer Harassed Him Over Playgirl 'Lumberjack' Photos

Daniel Sawka in Unless you're pursuing a career in, say, reality television, posing naked probably is unwise. The Internet is filled with stories of women fired after decades-old sexy photos of them surfaced. Now, it seems that men who pose naked and want regular jobs also face risks.

Daniel Sawka has filed a lawsuit against ADP, his former employer, alleging that his co-workers mercilessly mocked him constantly after discovering that he'd posed for Playgirl 18 years earlier. Only a month after Sawka joined ADP as a district sales manager in 2009, he says that his co-workers discovered the Playgirl photos in which he posed as a "naked lumberjack," and began shouting, "Timber!" whenever they saw him, according to his lawsuit (reported by Courthouse News).

"Jokes and comments [were] made. ... about the plaintiff's body parts, including his genitals, and a comment about homosexual men viewing the photos and what they would be doing while viewing the photos," the lawsuit said.

Sawka claims that he repeatedly asked employees to stop "googling him" and "leave me alone," but they persisted, calling up the Playgirl photos at work and making frequent references to them -- even at awards meetings in front of people he barely knew.

Daniel Sawka on PlaygirlHe says that in March 2011, he was "constructively discharged" -- a legal term which means that working conditions became so intolerable that the employee felt forced to resign. He's seeking damages for back pay, bonuses, personal days, and lost pension.

According to his LinkedIn profile, Sawka managed a territory selling ADP small business services and was named "Top District Manager Of the Week" for the region six times. A month after he left ADP, he joined a Connecticut firm as an account sales representative, where he still works. He's also apparently a model and is represented by Ramona's Talent. ADP spokesman Kevin Bryla declined to comment, saying it is "an active investigation."

It never ceases to amaze me when people adopt civil rights at their personal property, then use it as a weapon on everyone else. This clown assumes the freedom to flaunt his nakedness in "public" as his right, freedom of speech to earn a living however he choosed. Then, when he gets reaction that he doesn't like, LAWSUIT, can't work under those conditions. His past suddenly caught up with him and people reacted. Suddenly, people who knew him with clothes, see him without clothes. There's NO REGULATION of how people must react to that. Obviously, it didn't please Dan. While he flaunted himself shamelessly, offended anit-porn people, moralists, modest people, at the time, now he wants to sue people for offending HIM. What about all those HE offended? Tough luck, Dan. Karma caught up with you and you can't handle it, emotional midget.

He signed a release form acknowleging that he was giving up full rights to the photos. They were published in a magazine any member of the public over the age of 18 could buy at just about any convenience store in the country. Any moron with a modicum of common sense would realize that when you pose for a magazine under those circumstances, you are accepting the modeling fee in return for the consequences of living with the results for the rest of your life. This guy signed the release and he took the money. Quit whining and deal with it. You asked for it.

Harassment isn't funny, but now his past has gone viral and national. His molehill has become a mountain, and he's also become a male model, in spite of this embarrassment?
Does anyone else wonder if Daniel wants attention?
Kim K. was inconsolable when her sex tape with Ray J. got out, but then kept putting herself out there with bikini shots on instagram and her TV show. Made many doubt her sincerity. That's kind of how Daniel is coming across.

the big deal is that he is being harassed at work, ok, at first everyone laughs, but when it continues, it's gone to far, I would fire everyone at work that was going on these sites while using the work computer, obviously they are not working.

You think women are jealous of each other, men are as bad if not worse!!! I bet 99.9% of them harassing him wish they were him. He is very good looking and should keep his chin up and go for it! If the men want to look more like him get off your couch, put down your beer and go to the gym!!!
