Contract Employees: Should They Have to Pay for Their Own Thong?

Nine exotic dancers, employed as independent contractors, got a conditional okay from a federal judge to proceed with a class action lawsuit against the Penthouse Executive Club for alleged violations of federal and state labor laws.

That means that other women employed as contract workers by Penthouse Executive Club can join the lawsuit now that it's been conditionally certified as class action. The defendant claims that since the women are independent contractors they are not protected by the traditional federal and state labor laws. Therefore, this case will be closely watched by other contract employees.

The grievances by the strippers, reports the New York Post, include:

  • Must pay for their own uniforms, that is, thongs
  • Employer didn't pay minimum wage or overtime and confiscated part of tips
  • Employer charged dancers a house fee for dance shifts
  • Employer deducted a 20 percent premium when dancers exchange the house tokens, which some customers used for tips, for cash.

uhm..they dont pay state or federal taxes so why should they get the same rights as every other tax payer. also, as an independent employee these expenses should be filed with their taxes in january...oh wait, they don't pay that either. these girls make in a week what most people make in a month..it's not our fault or the clubs fault the money goes up their nose, in the mouths or spent on shopping sprees. maybe if they budgeted their 70+ thousand dollar a year income they wouldn't be so upset over thongs. go to school and stop having sex with your lawyers clients.

1. Nobody is FORCING them to work there. If they don't like the working conditions, then LEAVE! If enough women do, they'll be forced to change their working conditions. That's called FREE ENTERPRISE.

2. A thong is intimate apparel, and it cannot be worn by another employee for sanitary reasons.

3. Please make conditions even worse, so these women will be forced to do something else, preferably more modest and respectable.

It's nice to know that these women are standing up for their rights. However there are too many "tawdry" and "unusual" stories of this nature on the Internet today. How about some stories of how some, (or many!) of these ladies are using the money they earn to put themselves, (and/or members of their families), through college, getting their own homes, or bettering their lives in other ways? I'm sure more than one stripper is happily married, and doing this stripping only as it pays highly? What do husbands and boyfriends (and parents!), or other relatives think of these women, young or old who strip for a living?

Any news on the winners of the 2009 or 2010 High School science fairs? Or on former migrant labourers who have just completed their PHD degrees? UPLIFTING stories of REAL HUMAN ACCOMPLISHMENT, which can INSPIRE us are what we want now!!!!!!

Yes. It is true what you say. However, it is sad. So many young girls are not taught the value of modesty, self-control, what self respect really is, chastity, etc...
(Philosophy & Ethics training speaking-not religious beliefs some people do not know the difference of that either)

Without morals you get used and you become a user - just like the hedanistic tribes who eventually turn to canabalism. Having no respect of the human person.

The sad thing is regarding the stripping business is the woman gives away all of her power - her dignity; while the man becomes more impowered through her money. In the end, he is a slobbering pig gropping the new crop of strippers; The women are spit out like cancer...even the ones who manage to marry one of the JOHNS.. I've seen it a hundred times.

Truth is that they are Independant Contractors. They can work anywhere they choose and they are wearing a Dance Costume, not a uniform, therefore they have to or should pay for their own Costumes. I have nothing but respect for these women, however, that being said, Get a grip. They make Quite a decent salary and they do not have to be worried about getting Laid off. I say stop bitching about it. They make very good money and though I do not deny them their due... enough is enough. Pretty soon they will want hazzard pay for Pole dancing.

Women with low moral standards should expect to get very little respect. They are being taken advantage of in most cases because they get very little respect. Some strippers moonlight as prostitutes, making stripping in some clubs a stepping stone to prostitution for some women.

I do judge your profession because I know ALL about it..the minipulations of sexualality claimed as entertainment, the excuses, the vulgar gropping men, etc.. all for the almighty dollar. I make a judgement on the profession, not you as a person.
However, by your owns words..."..would like to be treated...second class citizens, on the margins..desenfranchised, sub-culture.." Regardless if the LAW grants you greater protection or not, you are still NOT in a respectable profession and will not get the RESPECT you desire. It is clear that you wish to have your business more respected by others. You will not ever have respect with your profession..and your profession will ALWAYS use, manipulate and dispose at the expense of your most sacred and personal demension of your personhood - your sexualality.

By the way, my co-workers respect each other...we don't have problems with gropping sexually depraved men, being spit out like cancer once someone reaches the droopy boob stage, or embarassment at my kids annoucing in school what kind of work Mom does for a living.

I will take this moment to speak of your comment regarding "..the man next to me.." Most men ARE respectable people. They love to be leaders and protectors of women while respecting thier abilities and attributes and of beauty. Beauty in expressing our womanhood in a respectful, tasteful manner by our attractive dress (not slutty), our gentleness, our encouragement of others, etc.. They love it when we are CLASSY. I love men and I have yet to find a man who was disrespectful of me.

You don't have that...it is obvious by your own words that you wish you did.

I do wish you the best..I hope you gain some protection from the LAW..but, it will only help to keep more money in your pocket. It will not give respect to your profession.

You as a person deserve more than what your profession has to offer.

People are so quick to judge others, have you no faults? Were you too pretty to learn how to spell? Just because you have no repect for her profession, does not mean that everyone feels that way. Look at the votes that your comments have received versus Wabisabi's. I agree that there are some dancers or entertainers who are ethically corrupt, but there are also CEO's and politicians who are just as bad, if not worse. At least dancers are not stealing money, or cheating people out of it, the men GIVE them money, they EARN it, whether you respect it or not. You are entitled to your opinion, and no one's opinion is wrong, but you could have nicely kept your rude comments to yourself. I'm sure many self respecting dancers did not appreciate your point of view. It's funny how an actress can portray a stripper in a movie, make a lot of money, and receive an abundance of praise for it, but actual strippers just seem to be judged negatively. One factor in your life does not define who you are.

BEING INDEPENDENT CONTRACTORS THEY SHOULD HAVE TO SUPPLY THIER OWN TOOLS OF THE TRADE, NOW IF THEY ARE REQUIRED TO WEAR A SPECIFIC OUTFIT BY THE PLACE THEY WORK THEN IT SHOULD BE PAID BY THIER EMPLOYER,
BEING INDEPENDENT CONTRACTOR THEY HAVE TO SIGN A CONTRACT TO WORK, ITS THER CHOICE TO SIGN OR NOT!! IF THEY WANT THE WORK THEN GET ON WITH IT..IF YOU DONT, DONT......
